Privacy Notice (KVKK)
1. Data controller
This notice is issued by Phoenix AI Technologies ("Phoenix", "we") as the data controller under the Turkish Personal Data Protection Law No. 6698 ("KVKK"). Contact: destek@phoenixai.stream
2. What data we process
- Transaction security: IP address at sign-up and when connecting; sign-up time and the consent you gave; a device ID derived from a key generated on your device; connection and job times.
- Device information: device name, graphics card model, graphics memory, current load and temperature, how long your computer has been idle.
- Contact: if you write to us for support, your email address and our correspondence.
- Usage information: the amount of work you give to and take from the network ("work units").
- Job contents: the requests you type into Phoenix and the answers produced for them. They are encrypted end to end: they open only on your device and on the device that produces the answer. The central server only relays them encrypted; it does not write them to disk and deletes them from memory at the latest 10 minutes after the job ends.
3. For what purposes
- Creating your account and linking your devices to it,
- Matching jobs with suitable devices and delivering the answers to you,
- Keeping the fair-use record (work given and taken),
- Keeping the network secure and preventing abuse and cheating,
- Improving the alpha and answering support requests.
4. Legal grounds
- Account, matching and fair-use record: necessary to enter into or perform a contract (KVKK art. 5/2-c).
- Security and abuse prevention: our legitimate interest (art. 5/2-f).
- Legal obligations: compliance with a legal obligation (art. 5/2-ç).
- Processing your requests on devices in the network so that they can be answered, and transferring them for that purpose: your explicit consent (art. 5/1 and art. 9; see the Explicit Consent Text).
5. Who we share data with
- Devices in the network: the request you type into Phoenix is transferred over an encrypted connection to the device selected to produce the answer and processed there; the Phoenix app does not record this content. These devices may belong to other people taking part in the network and may be outside Türkiye. The files and other information on your computer are never accessed.
- Infrastructure providers: the providers of our server hosting and domain services, to the extent the service requires.
- Competent authorities: where required by law.
6. How we collect data
Electronically, by automated and partly automated means, through the sign-up form, the Phoenix app and our servers.
7. How long we keep data
Your account data is kept as long as your account is open. When you ask for your account to be deleted, it is deleted or anonymised within 30 days at the latest. Job contents are not stored (see section 2).
8. Your rights
Under KVKK art. 11 you have the right to learn whether your personal data is processed; to request information if it is; to learn the purpose of the processing and whether the data is used for that purpose; to know the third parties it is transferred to; to have it corrected if it is incomplete or inaccurate; to have it deleted or destroyed under KVKK art. 7; to have these actions notified to the third parties it was transferred to; to object to a result against you that arises exclusively from automated analysis; and to claim compensation if you suffer damage from unlawful processing.
